Student Terms of Service

These Student Terms of Service (“Terms”) govern your use of the RightNowTutoring website (“Site”) at https://www.rightnowtutoring.com, any mobile device application or any other means provided or authorized by RightNowTutoring (“RightNowTutoring”) as a Student. Please read these Student Terms before using or continuing to use the Site. Do not agree to the Terms unless you fully understand and accept each provision. By using or continuing to use the Site, you represent and warrant that you understand, agree to, and accept all terms and conditions contained in these Terms.

1. General Terms

RightNowTutoring provides this Site to Users seeking tutoring services (“Students”). A valid credit card is required to be held on file with our PCI-compliant third-party payment processor. Payment for each completed lesson is due immediately upon conclusion of the session. If payment is not remitted within 24 hours, you authorize RightNowTutoring to automatically charge the card on file. Each payment is subject to a 3.5% credit card processing fee.

2. Eligibility

To use the Site as a Student, you must be at least 13 years old, or the minimum age of digital consent in your jurisdiction. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You also agree to provide accurate information and keep your account details up to date.

3. Student Responsibilities

Students agree to use the Site solely for lawful and educational purposes. You shall:

  • Attend scheduled lessons on time and communicate cancellations or rescheduling at least 12 hours in advance.
  • Refrain from sharing your account or login credentials with any other person.
  • Provide accurate learning needs, goals, and any relevant academic information to tutors.
  • Comply with all applicable laws, including those relating to online conduct and intellectual property.

4. Scheduling, Cancellations, and No-Shows

Lesson scheduling is arranged between Students and Tutors through the Site. Sessions cancelled with less than 12 hours’ notice may be charged in full at the Tutor’s discretion. A no-show—defined as failing to attend a scheduled lesson without notice—may result in being charged the full session fee. Repeated no-shows may lead to suspension or termination of your account.

5. Payments and Fees

Students must maintain a valid payment method on file at all times. By using the Site, you authorize RightNowTutoring and its payment partners to charge your card for:

  • Lesson fees for completed sessions;
  • Applicable service or administrative fees;
  • The 3.5% credit card processing fee per transaction;
  • Any late or outstanding balances owed.

All payments are non-refundable unless required by law or explicitly stated otherwise by RightNowTutoring.

6. Prohibited Conduct

Students are strictly prohibited from engaging in any of the following:

  • Harassment, abuse, or inappropriate conduct toward Tutors or other Users;
  • Attempting to bypass the Site to directly pay or communicate with Tutors off-platform;
  • Recording lessons without explicit written consent from the Tutor;
  • Posting or distributing unlawful, misleading, or harmful content.

7. Disclaimer of Warranties

RightNowTutoring does not guarantee any specific academic outcome. All tutoring services are provided “as is” and “as available.” RightNowTutoring disclaims all warranties, whether express or implied, including but not limited to the quality, accuracy, or reliability of any Tutor or content provided through the Site.

8. Limitation of Liability

To the fullest extent permitted by law, RightNowTutoring shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any tutoring services. RightNowTutoring’s total liability for any claim shall not exceed the amount paid by you for the applicable tutoring session giving rise to the claim.

9. Termination

RightNowTutoring reserves the right to suspend or terminate your account at any time for violation of these Terms, misuse of the platform, or non-payment. Upon termination, all outstanding balances remain due and payable.

10. Modifications to the Terms

RightNowTutoring may update or modify these Terms at any time. Changes become effective upon posting to the Site. Continued use of the Site after such changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which RightNowTutoring operates, without regard to conflict-of-law principles.
